Shannon Schott on the Sentencing Phase in the Aiden Fucci Case

News4JAX turned to Shannon Schott, a Florida Bar Board-Certified Specialist in Juvenile Law, for perspective on the Aiden Fucci case. Shannon is not involved in the case.

In January, after jail reports described fights and threats, Shannon said the reports reflect the reality for incarcerated children, who often have little supervision or resources, and that the State would scrutinize the credibility of inmate witnesses.

After the guilty plea, Shannon explained that the plea gave up pretrial issues that could have been appealed. At sentencing, she said, the defense would tell the full story of the defendant’s life and the failures that led to the crime, possibly including evidence about brain development and mental health. She also explained that under Florida sentencing law, remorse cannot be considered.
